Shane Padgett was in court Wednesday afternoon for a pre-trial hearing. Padgett
is accused of murdering Cara Holley in July 2010.
A judge denied the defense’s motion to declare the Virginia death penalty
The defense also made a motion for a juror questionnaire, saying it would get a
jury seated faster. Lawyers say questions would be about prejudice, bias and
religious beliefs regarding the death penalty.
The Commonwealth attorney argued they want to see the potential jurors reaction
in person when questioned about death penalty beliefs.
The judge says he’s not adverse to the use of a juror questionnaire but had
some logistical concerns. No decision was made during today’s hearing. The
questionnaire will again be discussed at the next hearing, scheduled for May
The trial is scheduled to start October 29th.
